Terms of Service
These Terms of Service (the "Terms") are an agreement between you and Reciprocity Holdings LLC ("we," "us," or "ParkStamp") governing your use of the ParkStamp mobile app (the "App"), the website at parkstamp.com (the "Site"), and the accounts, stamp collection, photo, and community features we provide (together, the "Service"). By creating an account or using the Service, you agree to these Terms.
How we handle your personal information is covered separately in our Privacy Policy, which is part of these Terms.
1. Who Can Use ParkStamp
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms. By using the Service you confirm that you meet these requirements and that you are not barred from using it under applicable law.
2. Your Account
ParkStamp uses passwordless sign-in. You can create an account with a "magic link" sent to your email address, or with Sign in with Apple or Google. You are responsible for keeping access to your email account and devices secure, and for activity that happens under your account.
You agree to provide accurate information and not to impersonate another person or create an account on someone else's behalf without permission. One person, one account.
3. What ParkStamp Is — and Isn't
ParkStamp is a digital collecting and record-keeping app for U.S. National Parks. It lets you record park visits, earn stamps, add your own photos, and view park information sourced from the National Park Service.
ParkStamp is provided for general informational and entertainment purposes. It is not a navigation, mapping, emergency, or safety tool, and you must not rely on it as one. Park information — including descriptions, hours, alerts, weather, and locations — comes from third-party sources and may be incomplete, delayed, or wrong. Always check official National Park Service sources and use your own judgment before and during any trip. You are solely responsible for your own safety and decisions in the outdoors.
ParkStamp is an independent product. It is built on official public data from the National Park Service but is not affiliated with, sponsored by, or endorsed by the National Park Service or any government agency.
4. Purchases
What you are buying
ParkStamp is free to use, with optional in-app purchases — individual stamp designs and bundles such as Complete the Map. When you buy a stamp, you are purchasing a personal, non-exclusive, non-transferable, revocable license to view and display that stamp artwork inside the Service. You are not buying the artwork itself, the copyright in it, or any physical item, and you receive no ownership interest. Stamps have no cash value, cannot be sold, traded, gifted, or transferred, and cannot be redeemed for money.
How purchases are processed
All in-app purchases are processed by the Apple App Store or Google Play and managed through our purchase provider, RevenueCat. Your purchase is also subject to the terms of the applicable app store. We never receive or store your payment card details.
Refunds
Because purchases run through the app stores, refunds are handled by Apple or Google under their policies, not by us. We cannot issue refunds directly. If you believe you were charged in error, contact Apple or Google support. If you think something has gone wrong on our end, email us and we will do what we reasonably can to help.
Restoring purchases
Purchases are tied to your ParkStamp account and your app store account. You can restore previous purchases in the App at any time. If you delete your ParkStamp account, you may lose access to your purchases, and we are not obligated to restore or refund them.
Prices and changes
We may change prices, add or retire stamp designs, refresh artwork, or change which parks are available as the National Park system itself changes. We will not remove a stamp you have already purchased from your account except as described in these Terms, but the artwork you see may be updated over time.
5. Your Content
You own your content
Photos you add, your display name, your avatar, visit notes, and anything else you submit are yours ("Your Content"). We do not claim ownership of Your Content.
The permission you give us
To operate the Service, we need your permission to handle Your Content. You grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt (for example, resizing or generating thumbnails), publish, publicly display, and distribute Your Content solely for the purpose of operating, providing, securing, and improving the Service.
The scope of this license follows your own privacy choices in the App:
- Private photos — stored for your account only, and displayed back to you.
- Photos you make public — displayed to other ParkStamp users in the community feed and related surfaces, alongside your display name and avatar.
You can make a public photo private again, or delete it, at any time in the App. When you do, we will stop displaying it going forward. Copies may persist briefly in backups or caches, and we are not able to retrieve copies that other users may have already saved or screenshotted. This license ends when you delete Your Content or your account, except for content you made public that others have already interacted with, and except as needed for backups, security, or legal obligations.
We do not sell Your Content, and we do not use it for third-party advertising.
Your promises about your content
You confirm that you have the rights to everything you submit, and that Your Content does not infringe anyone else's copyright, privacy, or other rights. Do not upload photos you did not take or otherwise have permission to use, and do not upload identifiable images of other people without their consent.
6. Community Rules
ParkStamp has a community feed where users share park photos. Keep it about the parks. We have zero tolerance for objectionable content or abusive behavior. You agree not to submit, post, or share content that:
- Is unlawful, defamatory, harassing, threatening, hateful, or discriminatory
- Is sexually explicit, obscene, graphically violent, or otherwise objectionable
- Depicts or promotes harm to people, wildlife, or park resources
- Infringes anyone's intellectual property, privacy, or publicity rights
- Contains spam, advertising, solicitation, malware, or deceptive links
- Reveals another person's private information
- Impersonates any person or organization, or falsifies visits or locations
You also agree not to misuse the Service itself — no scraping, bulk downloading, reverse engineering, circumventing purchase or access controls, interfering with our infrastructure, or using automated means to access the Service.
Reporting and enforcement
If you see content that breaks these rules, report it to us at support@parkstamp.com or through the reporting tools in the App. We review reports and act on them within a reasonable time.
We may, at our discretion and without notice, remove or hide any content, restrict or block a user, or suspend or terminate an account that violates these Terms. We are not obligated to monitor content, but we reserve the right to.
7. Our Content
The Service — including the ParkStamp name and logo, the stamp artwork, badge designs, illustrations, text, and software — is owned by Reciprocity Holdings LLC or our licensors and is protected by copyright, trademark, and other laws. Except for the limited license described in Section 4, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial use, and nothing more.
You may not copy, extract, redistribute, sell, or create derivative works from our artwork or other content without our written permission. Screenshots for personal, non-commercial sharing are fine.
Park information and photography retrieved from the National Park Service API are U.S. government works or are provided by the NPS and remain subject to their own terms and credits.
8. Ending Your Use
You can stop using ParkStamp at any time, and you can delete your account and its data from within the App or by emailing us. Account deletion removes your stamp book, visits, and photos from our active systems as described in the Privacy Policy, and may end your access to purchased stamps.
We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the Service. If we discontinue the Service entirely, we will make a reasonable effort to give advance notice.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that park information will be accurate or current, that GPS or photo-based park detection will be correct, or that any defect will be fixed. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RECIPROCITY HOLDINGS LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE — INCLUDING ANY DECISION YOU MAKE IN THE OUTDOORS BASED ON INFORMATION IN THE APP — WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnity
You agree to indemnify and hold harmless Reciprocity Holdings LLC from any claims, damages, losses, and reasonable legal fees arising out of Your Content, your use of the Service, or your violation of these Terms or of anyone else's rights.
12. App Store Terms
You get the App through the Apple App Store or Google Play, and their terms also apply to your download and use of it. For the App obtained through the Apple App Store, you acknowledge that:
- These Terms are between you and Reciprocity Holdings LLC only, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support for the App. Support requests should go to support@parkstamp.com.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal requirements, and claims arising under consumer protection or similar law.
- We, not Apple, are responsible for investigating and resolving any third-party claim that the App infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
These Terms govern the ParkStamp service. They supplement, and do not replace, any end user license agreement that applies to the App through the app store you downloaded it from. Where the two conflict as to the app license itself, the app store's license agreement controls.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. If we make a material change, we will make a reasonable effort to let you know in the App or by email. Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.
14. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. You and we agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Hamilton County, Ohio, and you consent to the jurisdiction of those courts. Nothing here prevents either of us from seeking relief in small claims court.
15. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Sections that by their nature should survive termination — including Sections 5, 7, 9, 10, 11, and 14 — will survive.
